Please read these Terms of Service ("Terms") carefully before using Pixel Spark games, websites, support services, or related features ("Services"). Pixel Spark is the publishing brand of an individual developer based in the People's Republic of China. By downloading, installing, accessing, or using our Services, you agree to these Terms.
1. Our Services
Pixel Spark creates mobile games and related services. Gem Coloring is our current product baseline. Our games may be free-to-play, ad-supported, and may include optional rewarded ads, events, cloud save, support, or other features.
2. Eligibility
You may use our Services only if you can legally agree to these Terms. If you are under the age required by law in your region, you may use our Services only with permission from a parent or legal guardian.
3. License
Subject to these Terms, Pixel Spark grants you a limited, non-exclusive, non-transferable, revocable license to use our games for personal, non-commercial entertainment purposes.
4. User Conduct
You agree not to:
- Reverse engineer, decompile, disassemble, modify, or create derivative works from our Services except where applicable law expressly permits it.
- Use cheats, bots, automation, exploits, unauthorized scripts, or other tools that interfere with normal gameplay or service operation.
- Access or attempt to access systems, data, or accounts without authorization.
- Use our Services for unlawful, harmful, abusive, or fraudulent purposes.
- Interfere with ads, analytics, security, or platform services used by our games.
5. Advertisements and Rewards
Our games may display third-party advertisements. Some ads may be optional rewarded ads that provide in-game benefits after completion. Ad availability, rewards, and ad providers may vary by region, device, platform, and game version. We are not responsible for third-party ad content or third-party websites.
6. Virtual Items and Purchases
Some Pixel Spark products may include virtual items, in-game currency, subscriptions, or purchases if enabled in that product. Virtual items have no cash value and are licensed, not sold. Purchases are handled by the applicable app store or platform and may be subject to that platform's terms and refund rules. Free-to-play products do not require purchases to play.
7. Intellectual Property
All content in our Services, including graphics, artwork, game design, text, audio, animations, software, names, logos, and trademarks, is owned by Pixel Spark or its licensors and is protected by applicable laws. You may not copy, distribute, sell, or create derivative works from our content without prior written permission.
8. IP Infringement Notices
If you believe content in our Services infringes your intellectual property rights, contact us at ranshuqing6537@gmail.com with a description of the work, the allegedly infringing material, your contact information, and a statement that you are authorized to act for the rights holder.
9. Updates and Availability
We may update, modify, suspend, or discontinue any part of our Services at any time. We may also change gameplay, features, levels, ads, rewards, or compatibility requirements. We do not guarantee that our Services will always be available, uninterrupted, or error-free.
10. Privacy
Our collection and use of information is described in our Privacy Policy. By using our Services, you acknowledge that information may be processed as described there.
11. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOU ACCESS AND USE THE SERVICES AT YOUR SOLE RISK.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIXEL SPARK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Pixel Spark and its operators from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the Services, (c) your violation of any law or third-party right, or (d) your interactions with third parties through the Services. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
14. Time Limitation on Claims
Any claim or cause of action arising out of or related to your use of the Services or these Terms must be filed within one (1) year after such claim or cause of action arose, or be permanently barred, except where applicable law in your jurisdiction requires a longer mandatory limitation period.
15. Termination
We may suspend or terminate access to our Services if we believe you violated these Terms, caused risk or harm, or used our Services unlawfully. You may stop using our Services at any time.
16. Apple and Google Platform Terms
If you obtain our Services through the Apple App Store or Google Play, you acknowledge that these Terms are between you and Pixel Spark only, not Apple Inc. or Google LLC. Apple and Google are not responsible for the Services or for providing maintenance, support, refunds, or any warranty related to the Services. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you. Your use of the Services must also comply with the applicable App Store or Google Play terms of service.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Published" and "Effective" dates and post the new version on this page. For material changes, we will update the "Effective" date to a future date to give you notice before the change takes effect. Continued use of our Services after the Effective date means you accept the updated Terms.
18. Governing Law
These Terms are governed by the laws of the People's Republic of China, without regard to its conflict of law principles. If you are a consumer in a region whose mandatory law gives you stronger protection or a local forum, those mandatory rules continue to apply to you.
19. Miscellaneous
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixel Spark concerning the Services and supersede all prior agreements.
Force Majeure. We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, government actions, network failures, or third-party platform outages.
Export Control. You may not access or use the Services in violation of any export laws or sanctions of the People's Republic of China, the United States, the European Union, or other applicable jurisdictions.
Assignment. We may assign or transfer these Terms or any of our rights or obligations under them without your consent. You may not assign these Terms without our prior written consent.
Headings. Section headings are for reference only and do not affect the interpretation of these Terms.
